These terms apply when you use the CardPriceCheck app for iPhone or the website at cardpricecheck.app (together, the “Service”), provided by CardPriceCheck LLC (“CardPriceCheck”, “we”, “us”). By using the Service you agree to them. If you don’t agree, please don’t use the Service. Our Privacy Policy explains how we handle your information.
The Service
CardPriceCheck helps you identify trading cards, see what they sell for, and keep track of a collection. You can scan, search and see prices without an account. An account lets you save collections and share them. Some features may require a subscription.
Prices are estimates
Prices, price history and collection values are estimates based on recent sales and listings from marketplaces and other sources. They can be incomplete, delayed or wrong, and a card’s identification or condition may not match yours. They are not an offer to buy or sell, an appraisal, or financial or investment advice. Check the details yourself before buying, selling or insuring a card.
Your account
- You must be at least 13 years old to create an account. If you’re under 18, you need a parent or guardian’s permission.
- You’re responsible for keeping access to your sign-in method secure and for what happens in your account.
- You can delete your account at any time from Profile in the app or by emailing us.
Your content
You own the collections, names and other content you add. You give us permission to store, process and display it as needed to run the Service, including showing a shared collection and your display name to anyone with its share link. Don’t use names or content that are unlawful, offensive, impersonate someone or infringe others’ rights. We may remove content or disable share links that break these terms.
Acceptable use
Please don’t:
- copy, scrape or resell the Service’s prices, catalog or images, or use them to build a competing service;
- reverse engineer the app, except where the law allows it;
- get around limits, access controls or subscription checks;
- interfere with the Service or other users, or use it for anything unlawful.
Subscriptions
Paid features are offered as subscriptions. In the app they are billed through your Apple ID; on the website, through Stripe. The price and billing period are shown before you buy. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. Manage or cancel an App Store subscription in your Apple ID settings, and a website subscription from your account page. Refunds for App Store purchases are handled by Apple under its policies. We may change prices with notice; a change applies from your next renewal.
Trademarks and third-party content
CardPriceCheck is an independent service. It is not affiliated with, endorsed or sponsored by The Pokémon Company, Nintendo, Creatures, GAME FREAK, Bandai, Riot Games, Wizards of the Coast, Konami, Disney or any other card publisher. Card names, images, logos and other marks belong to their owners and are shown only to identify cards and games. The Service links to other websites, such as marketplaces; we don’t control them and aren’t responsible for their content or for purchases you make there.
Our rights
We own the Service, including the app, website, design and our compilations of data, apart from the third-party content described above and your content. We give you a personal, non-transferable licence to use the Service under these terms.
Changes and ending use
We may change, add or remove features. We may suspend or end access for anyone who breaks these terms. You can stop using the Service and delete your account at any time. The sections on prices, trademarks, disclaimers, liability and governing law continue to apply after that.
Disclaimers
The Service is provided “as is” and “as available”. To the extent the law allows, we make no warranties, express or implied, including that the Service will be accurate, uninterrupted or error-free, or fit for a particular purpose.
Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, trading losses or lost data, arising from your use of the Service or reliance on its prices. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim and US$50. Some places don’t allow these limits, so they may not apply to you.
Apple App Store terms
If you use the iPhone app, these terms are between you and us, not Apple, and:
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for addressing claims relating to the app, including product liability claims, claims that it fails to meet a legal or regulatory requirement, consumer protection claims, and claims that it infringes someone else’s intellectual property.
- You confirm you are not located in a country subject to a US embargo and are not on a US government list of restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
Governing law
These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. Disputes will be heard in the state or federal courts located there, unless the law where you live gives you the right to bring them locally.
Changes to these terms
We may update these terms. We’ll change the date above, and if the changes are significant we’ll tell you in the app or by email before they take effect. Continuing to use the Service after that means you accept the new terms.
